In accordance with Clause 16 of the Environmental Planning & Assessment Regulation 2021, Council gives notice of its intention to repeal Section 7 – Development Process Matters of Burwood Development Control Plan.

Statutory Requirements

Clause 16 of the Environmental Planning and Assessment Regulation 2021 states that:

(1) A council may amend a development control plan by a subsequent development control plan.

(2) A council may repeal a development control plan—

(a) by a subsequent development control plan, or

(b) by publishing notice of a decision to repeal the plan on its website.

(3) At least 14 days before repealing a development control plan under subsection (2)(b), the council must publish notice of its intention to repeal the plan, and the reasons for the repeal, on its website.

(4) The repeal of a development control plan under subsection (2)(b) takes effect on the day on which the notice under subsection (2)(b) is published on the council’s website.

Reason for the repeal

The provisions are currently in the Community Participation Plan which was endorsed by Council on 26 November 2019. The Community Participation Plan provisions are now proposed to be incorporated into Council’s Engagement Strategy. This is currently a draft document, on exhibition. Effective Date

The repeal of Section 7 of the Burwood DCP will take effect from Monday 30 January 2023.
